Terms & Conditions

1. Scope

These General Terms and Conditions (hereinafter referred to as “T&Cs”) apply to the use of the software training platform „bluetelligence Academy“ (hereinafter referred to as the “platform”) provided by bluetelligence GmbH (hereinafter referred to as the “provider”). 

The platform offers the subscription to online training courses via the internet for customers and users (hereinafter referred to as “user” or “users”). 

2. Registration and Access

a. The use of the platform requires registration. The user is responsible for the accuracy of the data provided during registration.
b. Access credentials are personal. It is not permitted to share them with third parties. The user is responsible for the security of his/her access credentials. 
c. The provider reserves the right to suspend access to the platform without prior notice in case of a violation of these T&Cs or other legal provisions. 

3. Scope of Use and Duration 
a. The user has the right to access and use the training content available on the platform during the duration of their subscription or access period. The scope of use is specified in the respective course description. 
b. The duration of the user’s contract is also specified in the course description.

4. Use of the Platform

a. The user may only use the platform for lawful purposes and must comply with all applicable laws and regulations.
b. The user undertakes not to upload or share content that violates applicable law, is obscene, defamatory, harassing, or threatening. 
c. The provider reserves the right to remove content that violates these T&Cs and to suspend User accounts.

5. Payment Terms

a. The registration to the platform is free of charge. However, the registration for courses may be subject to fees. Current prices and payment terms are displayed on the platform for each course.
b. The course fees are payable in advance. 
c. Only temporary or partial use of the digital course content does not entitle the user to a reduction of the course fees. 
d. If another payment method than advanced payment is agreed and the customer is in default of payment, the provider is entitled to block the user’s access to the platform. Access will be granted again, when all outstanding depts are fully paid.

6. Cancellation and Refund Policies, Rescheduling

a. The user may cancel a paid subscription within 7 days of purchase and receive a full refund, only when the user has not yet started the course.
b. Rescheduling to different training content is available upon request only when the user has not yet started the course.

7. Copyright and Intellectual Property

a. All training content, videos, texts, and materials provided on the platform are subject to copyright and other intellectual property rights of the provider or its licensors.
b. The use of training content is restricted exclusively to the course participant. The user may store training content on his computer or mobile device but must ensure that no one else has access to it. 
c. Users may not copy, distribute, modify, or use platform content for commercial purposes without the written permission of the provider.

8. Disclaimer

a. The provider assumes no liability for the accuracy or completeness of the information provided on the platform.
b. It is not possible to create digital content in such a way that it works without errors under all circumstances. Internet failures do not entitle to warranty claims. 
c. The provider does not guarantee that the platform content meets the requirements and purposes of the user, will work with other programs used by the user, or that learning will be successful. 
b. The use of the platform is at the user’s own risk.

9. Privacy

a. The Provider stores and processes the user’s personal data in accordance with applicable data protection regulations. Further information can be found in the provider’s privacy policy.
b. During live courses, sound and image content from the user, the trainer and other course users is transmitted. The recording of this content by users is prohibited.

10. Changes to the T&Cs

The provider reserves the right to amend these T&Cs at any time. The revised T&Cs can be viewed on the platform.

11. Termination

The user may terminate the use of the platform at any time. The provider reserves the right to terminate user accounts in case of violations of these T&Cs.

12. Governing Law and Jurisdiction

a. German law shall apply.
b. The place of jurisdiction for all disputes arising from or in connection with these T&Cs is the registered office of the provider, provided the user is a merchant or a legal entity under public law. 

These T&Cs form the basis for the use of our software training platform. By registering and using the platform, the user agrees to these T&Cs.
